Agreement to Terms

By accessing or using The Capra Index ("the platform," "we," "us"), you agree to be bound by these Terms of Service. If you don't agree, please don't use the platform.

We may update these terms from time to time. Continued use after changes means you accept the new terms. We'll notify you of significant changes.

Eligibility

To use The Capra Index, you must:

• Be at least 13 years old
• Provide accurate information when creating your account
• Not have been previously banned from the platform
• Comply with all applicable laws

If you're under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf.

Virtual Currency & Betting

Important things to understand:

• Capra Dollars (C$) are virtual currency used for betting, trading, and in-platform activities. They are earned through gameplay, not purchased.
• Capra Coins are premium virtual currency. They also have no real-world value.
• Betting on matchups uses virtual currency only. This is entertainment, not gambling.
• No cash out: You cannot convert any virtual currency to real money, ever.
• No guarantees: Virtual currency balances, rankings, and achievements can be modified or reset at our discretion (seasonal resets, bug fixes, etc.).

Capra Pro Subscription

Capra Pro is our premium subscription ($5/month) that includes:

• 100 sentiment votes per day (double the free tier)
• C$30,000 monthly virtual stipend
• Unlimited bets and matchups (no daily limits)
• Advanced analytics and full CR history
• Ad-free experience
• Pro badge and community recognition
• Ability to opt out of aggregate data sharing

Billing & Cancellation

• Subscriptions are billed monthly through Stripe
• You can cancel anytime from your account settings
• Cancellation takes effect at the end of your billing period
• No refunds for partial months or unused time
• We reserve the right to change pricing with 30 days notice

User Conduct

You agree to:

• Be respectful to other users
• Not impersonate others or misrepresent your identity
• Not post spam, harassment, hate speech, or illegal content
• Not manipulate votes, rankings, or platform mechanics
• Not use bots, scripts, or automation without permission
• Not attempt to hack, exploit, or disrupt the platform
• Not create multiple accounts to circumvent bans or limits

Your Content

By posting content (comments, matchups, votes, profile info, etc.), you grant The Capra Index a:

This means we can:

• Feature your matchups or comments in ads, social media, or promotional materials
• Keep your content visible even if you delete your account (anonymized)
• Modify, format, or edit your content as needed
• Sublicense content to partners or future platform owners
• Use aggregated content for reports, analysis, or AI training

Your content must:

• Be yours to post (you have the rights)
• Not infringe on others' intellectual property
• Comply with our community guidelines

We can remove, modify, or refuse to display any content at our sole discretion, without notice or liability.

Prohibited Activities

The following will result in immediate account termination:

• Vote manipulation or coordinated inauthentic behavior
• Exploiting bugs for unfair advantage (report them instead!)
• Selling or transferring accounts
• Using the platform for illegal purposes
• Harassment, doxxing, or threats against other users
• Attempting to buy/sell virtual currency for real money

Content Moderation & DMCA

We reserve the right to moderate, review, edit, or remove any content at our sole discretion. We are not obligated to monitor content, but we may do so.

Copyright complaints (DMCA): If you believe content on our platform infringes your copyright, contact us through the help widget with:

• Identification of the copyrighted work
• Location of the infringing content on our platform
• Your contact information
• A statement that you have a good faith belief the use is not authorized

We're not liable for user-generated content. Users who post infringing content are solely responsible. Repeat infringers will have their accounts terminated.

Intellectual Property

Our stuff: The Capra Index name, logo, design, and code are our property. Don't copy, modify, or redistribute them without permission.

Artist content: We feature artists for commentary and criticism purposes. We're not affiliated with, endorsed by, or sponsored by any featured artists. Artist images and names are used for identification and editorial purposes.

Your stuff: While you retain nominal ownership of original content you create, by posting on the platform you grant us the broad license described in "Your Content" above. We don't claim ownership, but we have extensive rights to use it.

User Representations & Warranties

By using The Capra Index, you represent and warrant that:

• All information you provide is accurate and truthful
• You have the right to post any content you submit
• Your content doesn't violate any third party's rights (copyright, trademark, privacy, etc.)
• Your content doesn't contain viruses, malware, or harmful code
• You're not using the platform to break any laws
• You're at least 13 years old (or have parental consent)

If any of these turn out to be false, you're responsible for any resulting problems - not us.

Indemnification

You agree to indemnify, defend, and hold harmless The Capra Index and its operators, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Content you post or submit
• Your violation of these terms
• Your violation of any third party's rights
• Any dispute between you and another user

In plain English: If your actions on our platform cause us legal trouble, you're responsible for making it right. If someone sues us because of something you posted, you cover our costs.

Disclaimers

• Not financial advice: Rankings, CR scores, and market data are for entertainment only. Don't make real financial decisions based on them.
• Not gambling: All betting uses virtual currency that has no value. This is a game, not a casino.
• Availability: We may have downtime, bugs, or need to make changes. We'll try to minimize disruption but can't guarantee uptime.
• Third-party services: We use external services (Clerk, Stripe, etc.). We're not responsible for their availability or policies.

Limitation of Liability

To the maximum extent permitted by law, The Capra Index and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of virtual currency, rankings, or achievements
• Account termination
• Platform unavailability
• Actions of other users
• Data loss or security breaches

Our total liability to you for any claims shall not exceed the amount you've paid us in the past 12 months (or $50, whichever is greater).

Account Termination

By you: You can delete your account anytime from settings. See our Privacy Policy for what happens to your data.

By us: We may suspend or terminate your account at any time for:

• Violating these terms
• Abusive behavior
• Suspected fraud or manipulation
• Extended inactivity (with notice)
• Any reason at our sole discretion

Termination means you lose access to your account, virtual currency, and all associated data. There are no refunds for terminated accounts.

Dispute Resolution

If you have a dispute with us, please try to resolve it informally first by contacting us through the help widget.

These terms are governed by the laws of the United States. Any disputes that can't be resolved informally will be handled through binding arbitration, not court litigation.

You agree to resolve disputes on an individual basis. Class actions and class arbitrations are not permitted.

Changes to These Terms

We may modify these terms at any time. We'll notify you of material changes through the platform or email. Continued use after changes means you accept the new terms. If you don't agree with changes, stop using the platform.
